AT6 - Demokrati og suverænitet
Indledning
Med dannelse af kul- og stålunionen i 1952 påbegyndte et samarbejde mellem de europæiske stater, der skulle sikre kontinentet mod krig i fremtiden. Dette samarbejde blev videreført med dannelsen af EF i 1958 og EU i 1992. Tanken om et tættere samarbejde mellem landene har været målet i de mange traktater, der har efterfulgt hinanden. Ønsket om at samarbejde og ønsket om at bevare sin suverænitet har været en stadig udfordring i unionens levetid, og er ikke blevet mindre under den nuværende flygtningekrise samt gældsproblematikken i Grækenland. Med tanke på det ovenstående bliver jeres problemformulering derfor følgende:

Danmark, blandt andre lande, var skeptiske omkring traktaten og frygtede at miste suverænitet, union og yderlige tab af national bestemmelsen. Dog stemte alle medlemslandende til sidst ja til Maastricht-traktaten i 1995 og EF blev dermed til det EU vi kender i dag.
Maastricht-traktaten er, blandt andre traktater, vigtig for EU, da EU netop bygger på retsstatsprincippet.
"En traktat er en bindende aftale mellem EU's medlemslande. Den fastsætter EU's mål samt regler for EU's institutioner og for, hvordan afgørelser vedtages. Den fastlægger desuden forholdet mellem EU og dets medlemslande."
Som det tydeligt står beskrevet i citatet ovenfor, er traktaterne en slags retningslinjer for medlemslandende, som selvfølgelig er blevet godkendt på demokratisk vis. EU er en demokratisk organisation fordi det er folkevalgte repræsentanter, der sidder i EU-parlamentet. Folk er ikke stemt ind i EU på baggrund af nationalitet men i stedet deres ideologiske holdninger. EU har fire institutioner: Kommissionen, Ministerrådet, EU-domstolen og Europa-parlamentet. "Den almindelige lovgivningsprocedure" er det man kalder beslutningsprocessen i EU, hvilket betyder, at Europa-parlamentet skal godkende EU-lovgivningen sammen med Rådet.

Flygtningekrisen er i nogen grad et rigtig godt eksempel på, hvorledes det er problematisk for EU at stille sig i magt. Kompleksiteten af et sådant europæisk problem gør at det fra eu-komissionens side gør det vanskeligt at håndtere i sammenhold med at man stadig skal overholde de gældende forordninger og direktiver der er fastlagt for EU. Det er med tiden blevet et internationalt problem at EU skal kunne huse flere og flere immigranter uanset deres retlige status. Flere og flere lande begynder at nægte de tilkommende adgang til deres land. Dette kan vise en anelse småracisme i de enkelte samfund, hvilket påvirker moralen i EU meget kraftigt. Med ”moralen i EU” menes der at der på sign vis hele tiden skal være en god morale i de tiltag EU træffer, for at få det bedst, etisk mulige udkom. I EU er det meget ordinært at en af de mest centrale strategier har meget store menneskelige konsekvenser for immigranter og flygtninge. Her kan man tage udgangspunkt i nogle af de forslag, der sigter mod at styrke de såkaldte aftaler om af sende flygtninge tilbage til lande uden for EU – i EU-tale kaldet tredjelande. Her under kan vi også benytte os af Dublin-forordningen, som siger at man kan sende en flygtning tilbage til det EU-land hvor i de blev registreret først. Nogle EU-lande har valgt at træde ud af dublin-forordningen, hvilket menes at skabe større flygtningestrømme til det enkelte land. Europa-kommissionsformanden Jean-Claude Juncker har udtalt følgende på immigrationspunktet ” Every country should give refugees the right to work from the moment they reach the European Union” Hvilket groft oversat betyder at han gerne vil have flygtninge i arbejde allerede for første gang den dag de indtræde i et EU-land.
