As a 23 year old female, who is an avid hunter, I would like to state that I am a major supporter of the Second Amendment. I have been raised in a family of hunters, cops, and military veterans. Protecting my family and myself is a trait that has been instilled on me for my entire life. I take the responsibility of owning and operating a gun very seriously, and this is an issue that is very near and dear to my heart. I will be comparing the gun laws and regulations in both Tennessee and New York.

It is unlawful for any person to carry, possess or transport a handgun in or through the state unless he has a valid New York license. The New York definition of a firearm does not include an antique firearm. An antique firearm is any unloaded muzzle loading pistol or revolver with a matchlock, flintlock, percussion cap, or similar type of ignition system, or a pistol or revolver that uses fixed cartridges that are no longer available in the ordinary channels of commercial trade. A license is not required to possess, collect or carry an unloaded antique firearm. It is a felony for any person to manufacture, transport or dispose of a machine gun. It is a felony to buy, receive, dispose or conceal a machine gun that has been defaced for the purpose of concealment. If you own an assault weapon then you must either sell or register it with the State Police before April 15, 2014. Forms for registration are available online or you can obtain paper forms at the police stations and may be returned to the Pistol Permit Bureau. There is no fee for registering assault weapons. Please allow at least 3 business days for notification approving your registration. Confirmation of submitted form for registration (online) is NOT approval for registration. Failure to register by the aforementioned deadline will result in a misdemeanor, unless deemed unintentional failure to register which a 30 day extension to register will be allowed. Each registration of an assault weapon is valid for 5 years. Changes of name, address, or any contact information must be submitted via an amendment form. A transfer form also must be completed if the owner transfers the assault weapon out of state, to a firearms dealer, or a law enforcement agency or officer. The transfer must be reported within 72 hours of completing transfer. A transfer form also must be completed for any stolen, lost or destroyed assault weapon within the specified time frame. It shall be unlawful to possess any “assault weapon” or “large capacity ammunition feeding device.” So called assault weapons lawfully possessed prior to September 14, 1994 and large capacity ammunition feeding devices manufactured prior to such date can continue to be lawfully possessed.  The owner of a shooting range may present an affirmative defense in any suit brought against it in which noise or noise pollution is claimed in the suit. Any person lawfully in possession of a firearm who suffers the loss or theft of said weapon shall report the facts and circumstances of the loss or theft to a police department or sheriff’s office within twenty-four hours of the discovery of the loss or theft.

Subject to some exceptions, it is unlawful to sell or transfer a handgun to any person who is intoxicated or who is prohibited from gun ownership under the law.
